REAL ESTATE SERVICES FOR SELLERS

 

Typical services provided for Sellers include:

·Prepare the Purchase and Sale Agreement

·Negotiate the Purchase and Sale Agreement and review with client(s)

·Advise on the problems / issues that arise between the signing of the Purchase and Sale Agreement and closing date

·Draft and execute the Deed, Power of Attorney and other closing documents

·Coordinate closing and provide closing information and documentation to lender's attorney

·Obtain and agree on closing costs, adjustments and mortgage payoffs

·Correct outstanding title matters, if any.

·Attend closing and review, interpret and explain documentation

I will prepare the Purchase and Sale Agreement, Deed and other necessary documents. I will also request the following information from you:

·Copy of your deed, if available

·Current mortgage information, including bank's name,
address, telephone number and your account number

·Social Security Number and forwarding address

·Oil reading and Water reading, if applicable and
tenant rental information if a multifamily dwelling

·Paid receipts for real estate taxes, water and sewer charges may be required. If your property is in a town having a municipal lighting plant, you will need to provide a Light Lien Letter from the Town Light Department.

·Smoke Detector Certificate from the Local Fire Department and Wood Stove permit, if applicable.

·Keys and garage door openers / remotes, if applicable.

·Occupancy Certificate, if new construction.

·For condominiums, the name, address and telephone number
of Condominium Association contact person

REAL ESTATE SERVICES FOR LENDERS

 

Services typically performed for lenders may include the following traditional steps:

1. Perform a title search and certify clear title:

  • 50 year title search at the Registry of Deeds
  • Review all documents ,Write opinion letter
  • Inform the seller of what needs to be done to clear title problems, if applicable.


2. Order and review the Municipal Lien Certificate

3. Obtain from buyer proper evidence of insurance

4. Request payoff information from the seller's mortgages (usually banks and mortgage companies)

5. Obtain information for closing adjustments/apportionments

6. Prepare the loan documents (Note, Mortgage, Settlement Statement and other required documents)

7. Call borrower or borrower's attorney with itemization of closing costs

8. Call seller or seller's attorney with itemization of closing costs

9. Coordinate the closing with the lender (mortgage company or bank):

  • Call borrower's attorney for closing date and location
  • Call seller's attorney for closing date and location
  • Call listing broker with closing date and location
  • Call selling broker with closing date and location


10. Collect evidence of compliance with smoke detector law, Title V, and other applicable statutes

11. Attend the closing, interpret closing documents, review signed documents and review the deed

12. Record deed, mortgage and other title documents with the Registry of Deeds

13. Disperse proceeds

  • We will review and revise the Purchase and Sale Agreement and be responsible to ensure that all necessary documentation and information is obtained prior to closing.
  • We will keep in communication with all persons involved in your purchase so that your closing will proceed without difficulty and on schedule.
  • You must provide me with your mortgage lender's name, address, telephone number and contact person.
  • We will review Offer to Purchase
  • We will review the Purchase and Sale Agreement
  • We will negotiate the Purchase and Sale Agreement on your behalf, and review with client(s)
  • We will provide referrals to home inspectors and mortgage lenders and other professionals, if deemed necessary
  • We will review Attorney Certification of Title, Deed and other Documentation
  • We will advise on any potential problems / issues that arise between the signing of the Purchase and Sale Agreement and the closing date
  • Obtain and agree on closing costs and adjustments
  • Coordinate all facets of the closing
  • Attend closing and review, interpret and explain documentation
